By accessing or using the TeamOptix platform operated by Mr. Elmer, LLC, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the platform.
TeamOptix is a data-informed coaching platform offering coaching tools, assessments, team and individual insights, analytics, and collaboration features.
Users must safeguard their account credentials, provide truthful registration information, and report unauthorized access promptly. Account sharing is prohibited.
Users agree to use TeamOptix appropriately and lawfully. Prohibited activities include unauthorized access to the platform or other users' data, transmission of malware, interference with platform operations, and unauthorized copying or modification of the platform.
Access to TeamOptix is provided through your organization. Your organization's administrators control membership, permissions, and access to data.
Your organization retains ownership of all data entered into the platform, including assessment records, insights, coaching notes, and survey responses.
The platform may experience temporary unavailability due to maintenance or unforeseen circumstances, with advance notice provided when feasible.
The TeamOptix platform, including its design, code, features, and documentation, is the intellectual property of Mr. Elmer, LLC.
To the maximum extent permitted by law, Mr. Elmer, LLC's liability is capped at the amounts paid by your organization during the preceding twelve months, and excludes indirect, incidental, or consequential damages.
Users agree to indemnify and hold harmless Mr. Elmer, LLC from claims arising from misuse of the platform or violation of these terms.
We may revise these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
We reserve the right to suspend or terminate access to the platform for violations of these terms or for any other reason at our discretion.
These terms operate under the laws of the United States, with disputes resolved through good-faith negotiation or, where applicable, binding arbitration.
